A very exciting day at Sullivan: Nick O'Donnell is set to argue before the Supreme Court of the United States at 11:00am. The case of Federal Republic of Germany v. Philip centers on a case of Nazi-looted art dating back to 1935.
The two issues before the Court are: First, does the provision of the Foreign Sovereign Immunities Act of 1976 (FSIA) that establishes U.S. jurisdiction over claims concerning "rights in property taken in violation of international law" create jurisdiction for this case? And second, even if the statute applies, is there some other doctrine that justifies dismissing the case?
