Sullivan Litigator Arguing Today Before Supreme Court

Written by Ojen Sirin | Dec 7, 2020 2:30:00 PM

A very exciting day at Sullivan: Nick O'Donnell is set to argue before the Supreme Court of the United States at 11:00am. The case of Federal Republic of Germany v. Philip centers on a case of Nazi-looted art dating back to 1935.

The two issues before the Court are: First, does the provision of the Foreign Sovereign Immunities Act of 1976 (FSIA) that establishes U.S. jurisdiction over claims concerning "rights in property taken in violation of international law" create jurisdiction for this case? And second, even if the statute applies, is there some other doctrine that justifies dismissing the case?

The live audio stream will be carried by C-SPAN. Anyone interested in listening may click here. Note: users may need to log in through their cable TV provider to listen over the internet.

The case against Hungary, which involves some of the same legal issues, will be argued immediately prior at 10:00 a.m. The link to that case can be found here.

After the argument, the audio will be on www.oyez.org within a couple days, and on the Court’s website at www.supremecourtus.gov by the end of the week.

For further information about the case, see our prior press release here.
